7. Your Responsibilities as the Client
You are responsible for providing a suitable training environment, including adequate space for practical exercises (including floor-based activities such as chest compressions and recovery positions), access to the venue at the agreed time, and compliance with any health and safety requirements relevant to the activity. We will advise you of our specific space requirements at the time of booking.
You are responsible for ensuring that delegates are informed of the course content, format and any physical requirements in advance. Delegates with health conditions that may affect participation should inform us before the course date so that reasonable adjustments can be considered.
You agree to provide accurate delegate information (full names, contact details and, where required for certification, dates of birth) prior to the course date. Certificates cannot be amended or reissued without an administration fee where incorrect information has been supplied by you.
You must ensure that all delegates meet any specified prerequisites for the training. If, in the reasonable opinion of the instructor, training cannot proceed due to a failure to meet these obligations, the full course fee will remain payable and no refund will be issued.
8. Our Responsibilities
We will deliver the agreed training on the confirmed date using qualified and experienced instructors, and supply all necessary training equipment, including manikins, training AEDs and relevant course materials.
We will assess delegates throughout the course and issue certificates through Nuco Training (First Aid Awards Ltd) to all delegates who successfully meet the required standard.
The Safety Savvy Ltd holds public liability and professional indemnity insurance appropriate to the delivery of accredited first aid training.
We reserve the right to remove from training any delegate whose conduct is disruptive, threatening or likely to impair the learning of others. In such cases, no refund will be due in respect of that delegate's attendance.
9. Warranties
The Safety Savvy Ltd warrants that all courses will be delivered professionally, in line with generally accepted industry standards and the requirements of our awarding body (Nuco Training / First Aid Awards Ltd). Appropriately qualified and experienced instructors will be assigned to deliver training using suitable, current and approved course materials.
10. Certification
Certificates of completion will be issued to learners who successfully complete the required training and/or assessment. Certificates are issued by Nuco Training (First Aid Awards Ltd) on behalf of First Aid Awards Ltd (FAA) and are regulated by Ofqual under the RQF. Certification is subject to successful completion of all required assessment elements. Where a delegate does not meet the required standard, a certificate cannot be issued and no refund will be due in respect of that delegate.
Certificates will only be released once all course fees have been paid in full. Typical certificate validity periods are:
- Level 3 First Aid at Work (FAW): 3 years
- Level 3 Emergency First Aid at Work (EFAW): 3 years
- Level 3 Paediatric First Aid: 3 years
- Level 3 Emergency Paediatric First Aid: 3 years
- Level 3 Basic Life Support (BLS) and AED: 3 years (healthcare professionals may be required by their regulatory body to renew annually)
- Level 3 Annual Refresher: valid for the duration of the underlying certificate
It is the responsibility of the certificate holder and their employer to track expiry dates and arrange requalification in good time. We are not responsible for any regulatory, employment or compliance consequence arising from an expired or lapsed certificate.
11. Unforeseen Circumstances
In rare instances, unforeseen events may require The Safety Savvy Ltd to cancel a course. Should this occur, you will be notified as early as possible and offered either a full refund or a free transfer to an alternative course date. We shall not be liable for any indirect or consequential loss arising from such cancellation.
12. Sub-Contracting
The Safety Savvy Ltd reserves the right to assign or sub-contract any part of the training delivery to qualified instructors or third parties, where appropriate. Any such third parties will be bound by obligations equivalent to those in these terms and conditions.
13. Copyright and Intellectual Property
All course materials, handouts, presentations and content provided during training remain the intellectual property of The Safety Savvy Ltd and our awarding body partners. 14. Limitation of Liability
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by applicable English law.
Subject to the above, our total liability to you arising out of or in connection with any booking or course, whether in contract, tort (including negligence) or otherwise, shall not exceed the total fees paid by you for the relevant training session.
We are not liable for any indirect, consequential or special loss, including loss of profit, loss of business, loss of revenue or loss of anticipated savings, even if we were advised of the possibility of such loss. We are not responsible for the actions of any delegate following completion of training. First aid training does not guarantee a particular outcome in any real-world emergency.
